they, in and upon william whitnell , did make an assault
in the dwelling-house of the said ann tracey , putting him in fear, and taking from his person,

and saucers, value 1s. 6d. an iron shovel, value 1s. and a tinder-box, value 6d.).
Found guilty. Sentenced to death. Sentence outcome was
unknown.

BRIDGET HOWLEY . I am the
wife of Bartholomew Howley; we live in Sun-court , the prisoner lives opposite to me. On the 30th of
September, about twelve o'clock, I was looking out of the window of the next
house, and saw the prisoner come out of my house with a parcel wrapped up in
her apron; I had seen her go in, but I thought she went to the upper-part where
there was a room to let; when she came out she went to her own house - I went
in and missed seven yards of cotton, which I had seen five or six minutes
before on the tester of my bed; I then went to the prisoner's house, but she
was gone out.
MARY TREE . I live in
Sun-court. After the cotton had been pawned, I said to the prisoner, "You
did not behave well about the gown-piece;" she said she did not intend to
keep it for good.
LEONARD CLARA MATTHEWS . On
the 30th of September, about half-past twelve o'clock, I took in this
gown-piece of a woman; the prosecutrix called and
asked if I had taken in such a thing; I said I had, and described the person;
she went and took the prisoner; when I saw her again she was in a different
dress; I cannot swear to her.
JOHN BEE . I took the
prisoner.(Property produced and sworn to.)
Prisoner's Defence.
We had half a pint of gin together, and she wanted me to go and live in the
room; if I had wanted to make a thief of myself I might have done it on
Saturday night and Sunday night, when I went to get her to bed drunk and made
her bed; she says she saw me take it out of her house, and why did not she ask
me where I was going with it? I went for some rags down to a warehouse that I
work for, I brought them home, and she says it was her gown - she knows what my
friends said to her.
BRIDGET HOWLEY. They told me they would bring me a
gown-piece if I would not come here; but I said it was more than I could do -
we had no gin together.
GUILTY . Aged 34.

of his pockets, which made me suspect him. I charged him with it, he denied it,
and turned his pockets out. I felt something in his breeches, and found three
pounds of sugar there in a bag. He ran away, I followed and secured him.

goods of Rowland Ryley , from his person .
WILLIAM COLTON . I am an
officer. On Sunday evening last I saw the prisoner with another, following some
persons from Long-acre - I followed them in company with Reardon; I then saw
his companion take something from the prosecutor's pocket, and give it to the
prisoner; I followed the companion, but he made some resistance, and I did not
pursue my man any further. - Reardon secured the prisoner.
EDWARD HEDGES . I am beadle
of St. George's. I keep the Turk's Head. On Sunday night I heard a noise in the
street; I came down, and this witness and another ushered the prisoner into the
house; he said, "You shall not search me - you are no officer;" I
said, "Then I am, I will search you," and in his small-clothes I
found this handkerchief. I called on Mr. Riley the same night, who claimed it.
DANIEL REARDON . I was with
Colton - we watched the prisoner and another, who were following a gentleman
and a lady down King-street - his companion took a handkerchief from one of
their pockets; Colton followed him, and I followed the prisoner.
ROWLAND RILEY.
I was near the end of King-street, Long-acre , and Colton said, "You have
been robbed;" It expressed some difficulty about leaving my wife, as it
rained, but he said there was no occasion for that, as the person was in
custody.

I saw two young men pass me - they dropped this handkerchief, which I took up,
and put into my pocket.

BENJAMIN WARD . My father
lives in Holywell-street .
On the 27th of March, about a quarter to ten o'clock at night, I was in the
parlour, heard a noise in the shop, and saw the prisoner there taking these
boots off a line; he saw me, and ran out with them - I followed him to
Savoy-street, I lost sight of him for about two minutes, and saw him taken by
the Savoy. I am certain he is the man; the boots have not been found.
JOHN CLARK . I am a
constable. I was near the New Church; the prisoner passed me, and was stopped;
I did not see him with any thing; he said he was not
the man, but he was running before any body.

There was a cry of Stop-thief, a man ran by me with something, and I ran after
him.

s., the goods of John Ottley , from his person .
JOHN OTTLEY. On the 3d of June, about six o'clock in
the evening, I was in New Compton-street - I had used my handkerchief, and put
it into my pocket; I felt for it a second time, and missed it - I turned round,
and saw the two prisoners at my heels, and secured them; I took them into a
shop: they were both searched, but nothing was found. The street-keeper said I
could do as I liked about giving them in charge; I said I would, and as we were
going along we were pursued by the person into whose
house I had
taken them, who said he had found the handkerchief.
Cross-examined by MR. PHILLIPS.
Q. Were there any other persons in the shop? A. Yes; there might be four or
five. The handkerchief could not have been on any part of my person. Tracey
stood nearest the counter.
JOHN ARNOLD . The prisoners
were brought into my shop, and I saw them searched by the officer; they stood
near the counter, on the outside. Immediately they were gone I went behind the
counter, and found the handkerchief.
PHILIP RILEY . I searched the
two prisoners, but cannot say which I searched first - I think it was Ford.
TRACEY'S Defence.
I was just coming out of a coffee-shop, and this gentleman accused me of having
taken his handkerchief.
